Bill of Assurance
Lots 1 through 8, inclusive of Ridgewood Subdivision, as shown on
plat of record, envelope 5154A, and do hereby adopt said plat as our
plan of said subdivision and state as follows:
1. The streets shown on said plat of said subdivision are hereby
dedicated to the public use forever.
2. Easements for utilities as shown on said plat of said subdivision
are hereby established and the real estate shown thereon is hereby
declared to be subject thereto.
3. Said plat as filed for record shall not be changed unless said
subdivision be vacated according to law.
4. Said subdivision shall be restricted as follows:
(A): No building to be erected on said lands shall be used otherwise
then as a private single family dwelling house, and only one single
family residential building shall be constructed on each lot in this
subdivision, and no multi-housing residences, apartments, or
duplexes shall be permitted on any lot in this subdivision. No single
family residential building originally constructed in accordance with
these restrictions shall be later converted to more than a single
family residence.
(B): No dwelling shall be erected on any lot unless it contains a
minimum of eighteen hundred (1800) square feet of heated and
livable floor space. All dwellings shall be constructed with new
materials, which meet or exceed FHA specifications and the exterior
shall be either 20% brick, rock, or masonry construction, except for
gables and/or eaves, and shall be roofed with architectural grade
shingles.
(C): No trade or business shall be carried on upon any lot.
(D): No building shall be erected on any lot nearer than 50 feet to the
front lot line or nearer than 20 feet to any interior lot line or nearer
than 20 feet to any back lot line.
(E): No fence shall be permitted to extend beyond the 50 foot building
setback line.
(F): No house trailer shall be parked or placed upon any lot in said
subdivision; no shell house shall be erected upon any lot in said
subdivision: and no house shall be moved onto any lot in said
subdivision.
(G): All storage buildings placed on any lot and used in connection
with a residence on any lot shall be placed in the back of the
residence and shall be constructed of good quality material and
workmanship and be of a design and color so that it will blend in with
the residential building.
(H): Any additions to or remodeling of any residential building in this
subdivision shall be of the same quality of material and workmanship
as the original residential building.
(I): All driveways in said subdivision shall be constructed of a hard
surface material, such as concrete or asphalt for the first 50’ from
street.
(J): All mailboxes shall be constructed of either masonry or
ornamental metal.
(K): No lot in this subdivision shall be further subdivided after it has
been sold by the developer of this subdivision.
(L): All lawns in this subdivision shall be kept mowed and in neat
appearance at all times.
(M): No animals, livestock or poultry of any kind shall be raised, bred
or kept on any lot, except that dogs, cats, or other household pets
may be kept provided that they are not kept, bred, or maintained for
any commercial purposes.
(N): All rubbish, trash, garbage, and other waste shall be kept in
clean, sanitary containers.
(O): No tractor-trucks, tractor-trailers, or junk automobiles shall be
parked or kept on any street or lot in said subdivision.
(P): No noxious or offensive activity shall be carried on upon any lot,
nor shall anything be done thereon which may become an annoyance
or a nuisance to the subdivision.
(Q): No sign of any kind shall be displayed to the public view on any
lot except one sign of not more than five square feet advertising the
property for sale or rent, or signs used by the builder to advertise
the property during the construction and sales period.
(R): Enforcement of the covenants herein shall be by proceedings at
law or in equity to restrain a violation thereof or to recover damages
against any person or persons violating or attempting to violate the
provisions thereof.
